1. Acceptance of these terms
By creating an account or using Max AI (the "Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you don't agree, please don't use the Service.
If you're using Max AI on behalf of a business (a gym, a coaching practice), you represent that you have authority to bind that organization to these Terms.
2. What Max AI provides
Max AI is an AI-assisted fitness platform. The Service includes, depending on your plan:
- An AI chat assistant that answers fitness and nutrition questions.
- A workout builder that generates personalized training plans and tracks completion.
- Nutrition logging, including the ability to analyze photos of meals.
- Voice-based onboarding and coaching conversations.
- Programs and challenges you can enroll in.
- A "coach view" mode that lets a trainer you invite see and (with your permission) edit your workouts, tracking, and related data.
We're always shipping changes. Features may be added, modified, or retired at our discretion. We'll give reasonable notice for material removals that affect a feature you actively use.
3. Eligibility and your account
- You must be at least 13 (or 16 in the EU/UK) to use the Service.
- You're responsible for keeping your password secret and for anything that happens on your account.
- One account per person, please. Don't create accounts using another person's identity or false information.
- If you sign in with Google, you're also bound by Google's terms regarding your Google account.
- Tell us at support@notifications.maxfitness.info right away if you believe your account has been accessed without permission.
4. Acceptable use
You agree NOT to:
- Use the Service for anything illegal, harmful, harassing, or fraudulent.
- Attempt to reverse-engineer, scrape, decompile, or otherwise extract the underlying code or data of the Service beyond your own account.
- Probe, scan, or test the security of the Service or attempt to gain unauthorized access to other users' accounts or data.
- Use Max AI to generate content that is hateful, threatening, sexually explicit (especially involving minors), violently graphic, or designed to harass or harm others.
- Resell, rent, or sublicense the Service, or use it to build a competing product.
- Use automated systems (bots, scripts) to interact with the AI assistant in ways that exceed normal personal use, or that put disproportionate load on our infrastructure.
- Upload progress photos of any person other than yourself, or content you don't have the right to upload.
We may suspend or terminate accounts that violate these rules. Where relevant, we may report serious violations to law enforcement.
5. AI output and limitations
The AI assistant generates responses based on patterns in its training data and the context you give it. It can be wrong. It can be confidently wrong. It may:
- Misremember details from earlier in a conversation.
- Make up exercises, exercise names, or nutrition values.
- Give advice that doesn't fit your specific physiology or condition.
- Mistranscribe what you say over voice — especially numbers and proper nouns.
Always sanity-check anything that matters. Numbers shown in your tracker, nutrition logs, and reports are your own logs (we don't change them), but anything the AI suggests is a starting point, not a guarantee.
6. Health, safety, and medical disclaimer
Max AI is not a medical provider. Nothing in the Service constitutes medical advice, diagnosis, or treatment.
- Before starting a new workout or nutrition plan, consult a qualified healthcare professional — especially if you're pregnant, recovering from an injury, managing a chronic condition, or starting exercise after a long break.
- Stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptom that concerns you during an exercise.
- You exercise at your own risk. By using Max AI you accept full responsibility for any injury or harm that results from following its suggestions.
7. Free and paid plans
Max AI offers a free tier with limited usage and a paid "Plus" tier with expanded capabilities (unlimited conversations, photo nutrition analysis, the Instant Workout Builder, the ability to invite a personal coach, and other features as listed in the app).
- Subscription billing is handled by Stripe. By upgrading you agree to Stripe's terms and authorize recurring charges to your selected payment method until you cancel.
- Prices, billing intervals, and feature limits are shown in-app at the time of purchase and may change with notice for future billing periods.
- Sales tax / VAT is added where required by law and is not included in the displayed price.
8. Cancellation and refunds
- You can cancel a paid plan at any time from Settings → Billing. Cancellation takes effect at the end of the current billing period; you retain paid-tier access until then.
- Charges are non-refundable except where required by law or where we expressly state otherwise. We may grant refunds at our discretion for clear billing errors.
- If you delete your account mid-cycle, you forfeit any unused time on your current billing period.
9. Your content and our license
You keep ownership of everything you put into Max AI — your fitness profile, workouts you create, nutrition entries, chat messages, photos. We don't claim ownership of any of it.
To operate the Service we need a limited license to your content. By uploading or submitting content to Max AI, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display that content solely to:
- Provide the Service to you (show your workouts back to you, sync between devices, etc.).
- Pass it to the AI providers and infrastructure services described in our Privacy Policy.
- Provide coach-visible data to a coach you invite to your account.
- Back it up, secure it, and improve service reliability.
This license ends when you delete the content (or your account), subject to short retention in backups for disaster recovery.
10. Our intellectual property
The Max AI name, logo, software, designs, and all related materials are owned by us (or our licensors) and are protected by copyright, trademark, and other laws. These Terms grant you a personal, non-transferable, revocable right to use the Service — they don't transfer any ownership of our IP to you.
AI-generated text and workout plans produced for you in the course of using the Service are yours to keep and use for personal purposes. We don't claim ownership of those outputs.
11. Third-party services
Max AI relies on third parties (Supabase, Netlify, OpenAI, Anthropic, Stripe, Vapi, Deepgram, ElevenLabs, HighLevel, Resend, Google) to operate. Each is subject to its own terms and privacy practices. We're not responsible for outages, errors, or policy changes by those providers, though we work to choose reputable partners and to notify you of material issues.
The Service may also link to other websites. We're not responsible for the content or practices of those sites.
12. Termination
- You can stop using Max AI at any time and delete your account from Settings.
- We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, fail to pay, or use the Service in a way that harms other users.
- On termination, the rights you have to use the Service end immediately. The sections that should reasonably survive termination (your content license for backups, disclaimers, limitation of liability, governing law, indemnity) continue to apply.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.
We don't guarantee that the Service will be uninterrupted, error-free, or that AI output will be accurate, complete, or suitable for any particular use.
14. Limitation of liability
To the maximum extent permitted by law, Max AI and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or personal injury — arising from your use of the Service.
Our total aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 100.
Some jurisdictions don't allow exclusion of certain damages, so parts of this section may not apply to you. Nothing in these Terms limits liability that can't lawfully be limited.
15. Indemnification
You agree to defend, indemnify, and hold harmless Max AI from any claim, loss, or expense (including reasonable legal fees) arising from (a) your breach of these Terms, (b) your misuse of the Service, or (c) content you submit that infringes someone else's rights or violates the law.
16. Governing law and disputes
These Terms are governed by the laws of the United States and the state of West Virginia, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in West Virginia, and you consent to personal jurisdiction there.
Before filing any formal action, please contact us at support@notifications.maxfitness.info so we can try to resolve the issue informally.
17. Changes to these terms
We may update these Terms as the product evolves. For material changes, we'll notify you in-app or by email at least 14 days before the change takes effect. Continued use of the Service after the effective date means you accept the updated Terms. If you don't accept them, your remedy is to stop using the Service and delete your account.
